In 2020, the US Department of Education under (then) federal Secretary of Education Betsy DeVos amended Title IX regulations related to how schools must handle sexual harassment complaints among other things. This changed the process and compliance requirements for all schools. In 2021, the US Department of Education under the Biden Administration issued additional guidance related to how k-12 schools (including charter schools) must implement the 2020 regulations. The mandated training outlined in the guidance applies to all schools receiving Federal funds and nearly all charter schools receive Federal dollars via funding for special education.
Title IX has been around since the 1970’s and states that: “No person in the United States shall, on the basis of sex, be excluded from participation in, be denied the benefits of, or be subjected to discrimination under any education program or activity receiving Federal financial assistance.” Examples of the types of discrimination that are covered under Title IX include sexual harassment, failure to provide equal athletic opportunity, sex-based discrimination in a school’s courses and programs, and discrimination based on pregnancy.”
Among other new requirements, the 2020 amendments now require schools to post training materials to the school’s website and requires a school to adopt a process to address formal complaints. An updated Title IX Grievance Policy is available to CSDC members on our website, but we also strongly suggest that specified charter school employees receive the required training, per Title IX.
